TERMS OF SERVICE PER BOOKING FORM: 

Please take the time to read TERMS OF CONTRACT/SERVICE: 

This will eliminate extra time spent emailing questions that are on our terms of service.

Please know we are committed to making your wedding day more than you could have excepted, we are here for you & your questions.  

This Agreement (this “Agreement”) represents a binding agreement by and between Barefoot Beach Bride Inc, doing business as Barefoot Beach Bride, Coastal 59 Venue and Thistle Flower Bar located at 5909 Coastal Hwy, Ocean City, MD, 21842 and Client named on Barefoot Beach Bride Electronic Contract/Booking Form (“Client”), or proposal Contract and sets forth the terms and conditions between the parties hereto in connection with the Client’s event to be planned and executed by Barefoot Beach Bride Inc. on the set location and venue. Barefoot Beach Bride Inc. and the Client hereby agree as follows:

DESCRIPTION OF GROUP AND EVENT CLIENT CONTACT:  As Stated on the Barefoot Beach Bride Electronic Contract/Booking form and final day of the itinerary also known as a timeline.  The client is responsible for reviewing and confirming all final details are on the day of the itinerary/timeline. The literary/timeline is your wedding day overview.

TERMS OF CONTRACT/SERVICE: 

•All parties agree to the following: Barefoot Beach Bride Inc. also known as Barefoot Beach Bride, BBB, Coastal 59 Venue, Coastal Dining Room and Thistle Flowers will perform wedding services for the Couple named in this agreement provided by Barefoot Beach Bride Inc., Barefoot Beach Bride Inc. Digital Contract/Booking form and Honeybook Proposal Contract.

•It is the (Clients) responsibility to read the terms and conditions.

•The services provided will be in accordance with our published list of services that you have chosen on the Barefoot Beach Bride Digital Contract/Booking Form.

•All wedding details will be finalized by the client making such selections through their planning form/electronic planning program known as Honey book.

•Client is responsible for reading planning instruction that is emailed with their wedding confirmation/invoice.

•Once you have contracted with Barefoot Beach Bride additional vendors, and hotel references will be available on our website www.barefootbeachbridesoc.com under the client access tab.  Your password will be on your planning instructions. 

•Barefoot Beach Bride wants your special day to go without a hitch and we will work diligently to ensure a flawless occasion. 

•However, certain events beyond our control should prevent us from meeting our high standards,

•Barefoot Beach Bride is to be held blameless.

•We will, nevertheless, do everything in our power to rectify the situation that is outside our normal control. 

•If due to severe weather, acts of God, Epidemics, Pandemics, Government shutdowns, you may reschedule location, date, and time, based on availability. You will need to be flexible with the days of the week and times.

Contracted package

Includes all services described in selected package details reviewed and distributed to clients. Any additional services/products requested by the client incurred by the consultant will be billed directly to the client at cost. All services contracted cannot be deducted, but additional services can be added.

For your convenience, payments to consultants can be made through Honey Book.

Provided Documentation

All documentation created and provided to the client is owned and copywritten by barefoot Beach Bride and cannot be used or given to any other 3rd party.

Hotel Accommodations

Ocean City has many great places to stay.  Your planning, vendor and etiquette guide will have hotels in the block of your wedding and venue along with a link to the ocean city hotel page. 

Liability

It is understood that Barefoot Beach Bride is only liable for services completed and provided by Barefoot Beach Bride and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Barefoot Beach Bride be liable for consequential damages of any kind.

Cancellation Policy

If the event is canceled, no portion of the planning fees paid to Barefoot Beach Bride will be returned. If the event is canceled less than 6 months before the date, 2nd payment will be required to compensate for hours of service already rendered and loss of event date. If the event is postponed, services contracted can be applied to a new date if available (refer to Postponement Policy).

Postponement Policy

If the event is postponed, all services will cease at the time of notification of postponement if no determined new date is provided. The payment schedule will be determined and readjusted post new event date notification. If the client requires services to resume, post new event date is established, the second payment will be required at time-of-service re-start.

If the event/wedding is postponed, 100% of the payments will apply to a future event/wedding that operates within one year from the date of cancellation. Some previsions will be allowed to extend to two years.

Change date and administration fees will not be applied. Should the client wish to continue with the event, but because of travel advisories as to health, security, or terrorism, which might cause a reduction in attendance, the client shall be able to reduce its guest count accordingly, without liability and without a reduction in amenities that are contingent.

· Only one change will be made at no charge.

· Increases in food, vendor, or venue prices due to the cost-of-living increase can be added to final invoices. 

Responsibility

Barefoot Beach Bride Inc. and all associated vendors, staff, and venue are not responsible for any “acts of God” Government Shutdowns, Pandemics or terrorist acts Natural Disasters, such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of Barefoot Beach Bride, i.e., accident, death in the family, illness, pregnancy, or sudden tragic circumstance which make it impossible to hold your event. If it becomes unstable due to any of the above or unlikely events terminates doing weddings, Barefoot Beach Bride and all associated vendors, staff and venue cannot be held responsible for any additional costs or difficulties this causes to the client. In such a situation, Barefoot Beach Bride will obtain, upon approval of the client, a qualified professional replacement to fulfill Barefoot Beach Bride's obligations under the contract, at no additional charge to the client.

· Client indemnifies and holds harmless owners and Barefoot Beach Bride Inc, and all associated vendors, staff and venue, wedding planner or director from all damages caused to the client.  

· By signing/electronic contract booking form All parties agree to the terms and conditions above: 

Overtime

Additional unplanned and/or un-contracted services (such as but not limited to, a full redo of design, day-of wedding extension of time, services outside of the scope of the agreement, management of non-wedding day activities, etc.) are considered overtime and will be billed with prior notification and consent at the rate of $130 per hour.

Contracted Vendor and Payments

Any rentals and/or subcontracted vendors contracted on behalf of the client will be paid in full to Barefoot Beach Bride directly at the requested deadline. Proper notice will be provided per cost.

Damage or Loss of Accessories

The client agrees to exercise all due care in caring for and preserving the property of the consultant. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost.

Payment Schedule and Method

For your convenience, payments can be made online via HoneyBook.com using a valid credit card. Otherwise, payment is to be made by cash, check, or PayPal.

Note: PayPal incurs an additional 3% charge by PayPal that may be charged directly to the client.

A non-refundable planning payment is due upon completion of the signed agreement for services. The remaining balance is due as indicated in the schedule below: The amount of non-refundable planning payment is stated on each package and above. 

Attorney

If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in addition to any other remedies to which that party might be legally entitled.

Appropriate Conduct/ Safe Working Environment: CHOOSE WHAT STATEMENT BEST FITS THE PROJECT

{Event}

The Client(s) expressly agree(s) to take best efforts to provide Barefoot Beach Bride and Vendor’s staff with safe and appropriate working conditions. In the event of circumstances deemed by either Barefoot Beach Bride or a bystander to present a threat or implied threat of injury or harm to Barefoot Beach Bride staff or equipment, the [Vendor] reserves the right to cancel all services remaining under this Agreement and leave the event. At the [Vendor]’s discretion, the [Vendor] may enact a three-strike policy. After the first offense, the [Vendor] will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), [Vendor] shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, the [Vendor] will immediately leave the event. If the [Vendor] leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold [Vendor] harmless as a result of incomplete event coverage, or for a lapse in the quality of the [Vendor’s] work, and the Client(s) shall be responsible for payment in full.

{Non-Event}

The Client(s) expressly agree(s) to take best efforts to provide [Vendor] and Vendor’s staff with a safe and appropriate professional relationship. In the event of circumstances deemed to present a threat or implied threat of injury or unprofessional, harassing language or behavior to [Vendor] staff, [Vendor] will make reasonable efforts to notify the Client(s). If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time, [Vendor] shall resume work in accordance with the original terms of this Agreement. If the inappropriate behavior continues, the Client(s) will agree to relieve and hold [Vendor] harmless as a result of incomplete services under this Agreement, or for a lapse in the quality of the [Vendor’s]work. The Client(s) shall be responsible for payment in full, regardless of whether the situation is resolved or whether [Vendor] resumes work detailed in this Agreement.

The undersigned have read this contract, understand its terms, and agree to be bound thereby. Any additions, deletions, or revisions must be made in writing and approved by all responsible parties. The parties agree that this contract is the complete and exclusive statement of the mutual understanding of the parties.

VENDORS: 

Barefoot Beach Bride hires and communicates with all your vendors to include venues. All terms on this contract/Booking form apply to all vendors and venues scheduled with your wedding. 

PAYMENTS:

· A non-refundable payment of (amount stated on each package or custom proposal) This payment is due at the time of signing the contract to start planning your wedding, hold your event date, time, venue inclement weather space, administrative/clerical time, office, and banking expenses. 

· Your first payment & additional payments made will not be refunded as per these terms. Payments are Non-Refundable. We will transfer all payments to a new date within 1 year of the original wedding date. 

· The First Payment is due when this Agreement is signed (digital) the payment will be charged to the Authorized Credit Card (subject to a processing fee of 3% for Visa or MC, or 3.5% for AX). The payment will be deducted from the total amount due under this Agreement and adjusted final payments due 30 days prior to the wedding/event. During times of a pandemic, final payments will be due within 2 weeks of the wedding date

· First and final payments are payable by cashier’s cash, money order, or credit card (Visa, MasterCard, or Discover). •A credit card service fee of up to 4% will be charged on all credit card payments. •Payments are to be made to Barefoot Beach Bride. 

· The Client’s wedding date, time, and venue will be reserved upon receipt of payment. Reservations will not be confirmed until this payment is received. 

· Dates are not held without payment.

· Final guarantee of attendance must be submitted thirty (30) days prior to the Client’s event date. 

· Once a final guest count is given, only then will an exact price be determined. 

· All events require one hundred percent (100%) payment of the estimated cost thirty (30) days prior to the event date.

CREDIT CARD AUTHORIZATION:

· By signing (digital name signature), I Authorize Barefoot Beach Bride Inc.'s use of my Personal and or Business Credit Card for the Service I have chosen on the Barefoot Beach Bride Inc. Digital Contract/ Booking Form.

· Barefoot Beach Bride Inc. requires that the Client complete and execute the Credit Card Authorization on the Electronic Contract/Booking Form when Client executes this Agreement (the “Authorized Card”). The Authorized Card will be charged for any additional charges (day of event extension, additional guests added less than 10 days prior, etc.) to be paid to Barefoot Beach Brid Inc. by the Client. All payments due under this Agreement may be paid in cash, personal check, cashier’s check, or by Authorized Credit Card when due. 

 

WEDDING PLANNING FORMS & WEDDING PACKAGES:

·   Barefoot Beach Bride is a Pre-Designed Beach Wedding Service Company. 

·   Each Package is pre-designed with details, services, planning hours, and vendors.

·   Barefoot Beach Bride will schedule, communicate with all vendors, execute, and file all legal paperwork listed in package details.

    A detailed timeline will be prepared and updated during the planning of your wedding.  You are responsible to read and confirm all the details are correct prior to the wedding day for Barefoot Beach Bride to execute a flawless wedding. 

DECORATIONS:

· All our decorations are artificial are the property of Barefoot Beach Bride.

Custom fresh flowers are available for an additional fee and will be yours to keep.

· Barefoot Beach Bride does not allow packages to be mixed and matched. This will eliminate any mistakes on the Client’s wedding day. 

ADDITIONAL SERVICES

· You may add additional service to your package by completing the add-on form that will be emailed to you. 

· All added services will have an additional fee. You will receive a price before committing to adding items or services. 

· Barefoot Beach Bride will handle additional photography time and videographer booking and times.  All other service is to be handled by the client.

· Additional fees will be added to your final wedding package invoice.

Client May SUPPLY DECORATIONS to add on,

· The Client will be responsible for the setup and removal of their items. Unless agreed on prior to the ceremony.

· All additional items provided by the client will be given to Barefoot Beach Bride on the day of the wedding at the beach location 20 minutes before the ceremony start time if we are setting up.  If you are having them set up by a guest, they will arrive 20 minutes before ceremony time and set up.

· Reception Items are to be delivered to the venue the morning of the wedding.

PROVIDING OWN OFFICIANT / PHOTOGRAPHER

· Client may bring their own photographer\officiant.  

· You must add on your booking form that you are providing your Photographer. The photographer cost will be deducted from your package. Should you not notify Barefoot Beach Bride on the booking form Barefoot Beach Bride will assign a photographer at the booking time to your wedding to ensure you have a photographer at this time the Photographer may not be removed.

Barefoot Beach Bride is not responsible for communication or coordinating with your vendors. 

· You the client must provide vendors with your day-of timeline and assure they will execute with Barefoot Beach Bride.

Planning instructions/ Itinerary

·Barefoot Beach Bride will email your wedding planning instructions.

· It is the Client’s responsibility to follow wedding planning instructions and make final selections. 

· BBB will provide the Client’s ceremony/reception itinerary (day-of timeline) through your planning portal.

· Client will have 24-hour access to their planning portal known as a honey book.

· Barefoot Beach Bride wants the Client’s Day to be flawless, it is important to make sure we have all the details as performs correctly on the timeline.

Location

· Our Primary location is a public beach, 59th Street Ocean Side.

· We do move location at a time based on wedding schedule with receptions for each day. Your location will be assigned when you reserve your wedding date, will be noted on your planning form/itinerary.

· Barefoot Beach Bride will assign the wedding ceremony location based on the schedule for that day. 

· Should the client request a different street location, the client is subject to an up-charge on their package price Should Barefoot Beach Bride be available to move the ceremony beach location. 

· Barefoot Beach Bride has the right to change the beach location at any time due to permits, events in town, or beach construction. You will be notified.

· Please note all our Oceanside beaches are public beaches, we cannot control other people on the beach. We will do our best to set up in an area that is with fewer people or objects.  

·Guests are not allowed to ask any person on the beach to move. 

FINAL GUEST COUNT:

Chairs/Dinners/Receptions

· Your Proposal was prepared based on your estimated guest count. 

· The anticipated cost for the Event as of the date of this Agreement is agreed on through your Digital Contract/Booking Form (the Anticipated “Cost”). 

· The Anticipated Cost is calculated by multiplying the number of adults to attend the Event by the price per adult set forth; plus, the number of children to attend the Event is multiplied by the price per child set forth. The Adult Cost and the Child Cost are added together to determine the Anticipated Cost. The Anticipated Cost will not be reduced but may be increased in accordance with this paragraph. 

·The final attendance count for the Event must be received to Barefoot Beach Bride Inc. no later than Thirty-five (35) business days prior to the date of the event. 

·Your final invoice will be adjusted to the final guest count given on your final guest count form. 

·The final guest count shall set forth the number of adults and the number of children (and the age of the children) to attend the Event. 

· Should extra guests attend the Event, Barefoot Beach Bride Inc and or the Venue will accommodate the extra guests to the best of their ability, and the Client will be charged for each additional guest in accordance with the terms of this Agreement. All payments will be due by the closing of the event. 

·The Anticipated Cost as determined in accordance with this paragraph is considered guaranteed and is the minimum amount that Client agrees to pay Barefoot Beach Bride Inc and or the Venue for the Event, plus all other applicable service charges, taxes, labor charges, audiovisual charges, and any other miscellaneous charges incurred.

· You will receive a revised invoice within 30 days of your wedding.  

· Once the final guest count form is received, your account balance will be updated based on the final guest count. Once your guest’s count is given, we are unable to remove any guest cost. 

·You may add guests up to 10 days of your set wedding date.

· Payment will be due once the guest count has been updated. 

Please be on time.

Ceremony Late Fee

· Though your wedding is a priority on the date and time you are scheduled with Barefoot Beach Bride, we do multiple weddings per day and your contract times are extremely specific. 

· While we want you to enjoy your wedding day, we are on a schedule and time is of the essence. 

· For your protection, we request that you, your wedding party, any outside sub-contractors, and guests be on time for your ceremony and aware of these policies. 

· We receive a permit from the city and are allocated a specific time for the set-up ceremony and breakdown. 

· We allocate one hour on the beach for your ceremony and photography. 

· We will start breaking down or resetting the beach area for the next wedding. 

· You will be charged $300.00 per 30 minutes late if you are more than 40 minutes late, your wedding set-up will be taken down and your wedding ceremony will be canceled with NO Refunds.

· Please allow extra travel time when driving to your beach location. 

· We go over lateness and being on time.  Remind guests that the ceremony set-up will not be ready until 20 minutes prior to your ceremony start time.  Should they arrive earlier, we ask that they wait at the beach walkway until we greet them and invite them to the ceremony. 

· Keep in mind the heat and remind your guest to hydrate.

Damage to function space, decorations, and wedding items

·The Organization/Client agrees to pay for any damage to Barefoot Beach Bride or Venue property that is caused by the Client, their guests, or subcontractors.   •Barefoot Beach Bride Inc. does not permit the affixing of anything to any surface in the room.

· The use of silk flower petals for flower girls to through on the beach, confetti, loose glitter, rice, fog machines, incense, and real candles are not permitted. Battery-operated candles are Not Permitted. Unless agreed on in advance

· Barefoot Beach Bride is not responsible for damage or loss of any merchandise or articles brought onto Barefoot Beach Bride or Venue premises/beaches, or for any items that are left unattended.

· Once you and your guests have left the beach or venue all left items will be properly disposed of.

Date, Time, or Package Changes:

·There will be an administrative charge of $100.00, to change your wedding date or package once the payment has been paid. This is per change.

·Unless an unforeseen act of God, the government shut down or pandemic were to happen. In this case, the fee would not apply. Due to the amount of time required to change details, we will only make one change without charging the fee. All additional changes will occur a $100.00 per change fee.

· You may only upgrade your package; you are not able to go down in package once your contract has been completed and the payment has been paid. Unless an unforeseen act of God, the government shut down or pandemic were to happen. In this case, the fee would not apply. 

· We strongly discourage package changes to eliminate mistakes on your wedding day.

In the event the client(s) is forced to change the date of the event or wedding, every effort will be made by Barefoot Beach Bride to transfer reservations to support the new date. 

Inclement Weather:

· Barefoot Beach Bride will supply an indoor location for your ceremony at no additional charge. 5909 Coastal Hwy Ste E Ocean City, Md 21842

. In order to prepare for your wedding, we will make the decision by 10 am if the wedding has to be moved inside. 

· If we are asked to push our set-up time for the weather change to less than 2 hours prior to the ceremony time, there will be a $200.00 rush fee. Payment is to be paid day of the event. 

· We will offer a time change if all vendors, couples, and guests are flexible should we be able to work around the weather. 

· If the Client is having a ceremony & reception, all functions will be moved inside to the ballroom or event room of the reserved venue. 

· It is at the discretion of the Venue Manager and Barefoot Beach Bride to make the final decision if the event will be moved indoors.  •Barefoot Beach Bride, Alyosha Captain, or Venue Manager will make a final decision the morning of the scheduled event. 

· The arbor/decorations/chairs will be set up inside.

· Barefoot Beach Bride is not responsible for waterfowl, seaweed, high tides, rain, or thunderstorms. 

· BBB cannot control Mother Nature, but we can be flexible and hope that the Client will also. 

· It is recommended that you build flexibility into your plans. 

· Barefoot Beach Bride will not put any person or property in danger due to inclement weather.

Cancellations: 

·If (a) the Client cancels or otherwise abandons its planned use of the service or function space and catering commitment for any reason, or (b) the Event is canceled Barefoot Beach Bride or Venue because the Client did not make a payment to barefoot Beach Bride on or before the due date for such payment pursuant to this Agreement, (each a “Cancellation”), then the Client agrees that all amounts paid by the Client to Barefoot Beach Bride Inc. prior to the Cancellation shall be forfeited by the Client and retained by barefoot Beach Bride Inc. as liquidated damages. The Client and barefoot Beach Bride Inc. agree that the foregoing liquidated damages reflect a fair and reasonable estimate of the damages that would be sustained by Barefoot Beach Bride.  The Client agrees to notify Barefoot Beach Bride Inc. in writing immediately upon determining that a Cancellation by the Client is necessary. This contract is non-transferable.

·If your event is canceled for any reason the first payment is nonrefundable.   

·The originally agreed upon block of time is binding and any changes in date or cancellations of date will result in loss of first payment.

·If any cancellations are made 240 days or closer to the wedding date, it will result in loss of non-refundable first payment and payments made towards the account. •The venue has the right to require full payment for events canceled within 240 days of the scheduled date. 

·If the wedding is canceled within 6 months the full balance of the contract is due. Unless an unforeseen act of God, the government shut down or pandemic were to happen. In this case, the fee would not apply. 

·NO payments paid on the account will be refunded. 

·You will be held accountable for all balances due at this time.  Unless an unforeseen act of God, the government shut down or pandemic were to happen. In this case, the fee would not apply. 

·Please understand that the reservation of your event secures many businesses for your event time and date. 

We start working on your event in many ways, fees occur to Barefoot Beach Bride, administrative & travel time and permits anyone else from scheduling during your reserved date and time they cost the company loss of income. 

·These companies reply on the reservation as their livelihood. 

·Should your event get canceled or postponed the likelihood of the date being rescheduled in such a short time is not likely. 

·We take your event seriously and hope you understand this policy. 

·If the client is in arrears for final payment, you will be held accountable for said final payment.

· Accommodating requests for date changes are subject to availability. After the contract has been signed, cancellation or change of date will be accepted in writing/email only.     

Event Insurance: 

· BBB highly recommends the Client to consider insuring their event.

·Event Insurance is available through several insurance companies, including homeowners and renter’s insurance.

·The purpose of event insurance is to protect against any loss due to circumstances beyond our control, including but not limited to, acts of God, weather conditions, and/or construction.

·If the Client is unable to locate an insurance agent, please refer to: https://www.markelinsurance.com/event or www.totaleventincurance.com

·Barefoot Beach Bride Inc. is not responsible, nor will we book event insurance.

·All questions are to be directed to the event insurance company.

Marriage License:

·Questions pertaining to your marriage license must be communicated through the Clerk of Court in the county you are getting married in.  Ocean City Maryland Worcester county.

·Barefoot Beach Bride will provide you with instructions on how to obtain your marriage license through your planning pod forms. You will receive an email with instructions. 

· Barefoot Beach Bride Inc. is not responsible, nor permitted to obtain your marriage license. 

· The couple is responsible for obtaining the marriage license from the Clerk of the Court in Worcester County Maryland. (Ocean City Wedding)

·The clerk of court must be in the county in which the couple will be married.

·All weddings taking place in Ocean City are to obtain a marriage license in Worcester County.

· Marriage licenses are valid for 6 months and there is a 2 day (48 Hours) waiting period before the ceremony can take place.

. You must be 18 years of age or older.

·Cost of Worcester Marriage License $35 cash or money order

. If you are driving to Worcester County Clerk’s office to get your marriage license, please CALL to confirm if they are open, what documentation, and any questions you may have before driving to the courthouse.

Wedding details and communication:

·Due to the importance of your wedding details, all Communication pertaining to your wedding is to be directly with Barefoot Beach Bride and NOT with assigned vendors or venue.  We will not be held responsible if you have communicated with the vendor and not informed us Barefoot Beach Bride of agreements between you and them.

Wedding Coordinator:

·Barefoot Beach Bride Inc. will provide a professional Wedding Coordinator/ Planner for the planning and the day of the Client’s event.  Excluding elopement packages.

·Read your package details carefully, Elopement packages do not include a day-of coordinator.

·Barefoot Beach Bride coordinator’s/Planners’ primary function is to execute the event as specified in the Client’s contract/wedding day itinerary. 

·Wedding coordinators are scheduled in half-hour increments to assist with the Client’s wedding ceremony. 

·Additionally, wedding coordinators are scheduled in half-hour increments to assist with reception events. 

·If the Client enlists the services of an additional private coordinator, Barefoot Beach Bride Inc. will not recognize this individual as the contact for Barefoot Beach Bride. 

·Should the Client relinquish their decision-making authority to a private coordinator, the Client must additionally authorize any decision in writing to Barefoot Beach Bride Inc.

·Barefoot Beach Bride Inc. will only make changes to the Client’s contract and/or event with the Client and/or the financially responsible parties’ written authorization, as specified herein. 

Officiant:

·Barefoot Beach Bride will provide an officiant to perform the Client’s wedding ceremony. 

·The wedding officiant will complete the marriage paperwork following the wedding ceremony. 

·Thereafter, the officiant will mail the marriage paperwork to Worcester County where the wedding occurred. 

·Client will receive one certified copy of the marriage license from the Clerk of Court once filed by mail within 4-6 weeks of the wedding date.

·The officiant is not responsible and is prohibited by the State of MD for obtaining the marriage application or license.  

·It is the responsibility of the Client to obtain a Worcester County Marriage License. See marriage license above.

Should you provide your own officiant/pastor Barefoot Beach Bride is not responsible for the completion or filing of marriage license paperwork. It is the responsibility of your officiant/pastor.

Photographer/Videographer:

· Barefoot Beach Bride will assign your Photographer/Videographer.

. Once a photographer is contracted through Barefoot Beach Bride, he/she cannot be retracted

· In the event of a cancellation, reimbursements will NOT apply

· Photography will choose the best images from the wedding ceremony/day. 

  Does not show all the un-edited images, nor involve the clients in the process of choosing which images will be chosen for the final gallery.  

Photography spends a great deal of time going through each image individually.  Please rest assured that BBB will only show you the BEST of the BEST and any images that are unappealing (i.e., eyes closed, unflattering facial expressions, and most definitely, any images that do not meet BBB high professional standards will be deleted immediately).

The wedding collection of unedited, high-resolution images will be displayed in an online gallery within 

4-6 weeks of your wedding day

You will access it through the email link provided to you.

You can expect roughly 50-100 unedited images per hour of shooting time.

Elopement: 25-50 unedited images (30 minutes)

Ceremony: only 50-100 unedited images (1 Hour)

Ceremony with reception: 200-400 unedited images (5-hour day)

The number of images varies based on the number of bridal parties, number of family members, and number of guests.

You will need to download the images on a high-quality USB at no additional charge.

or you may purchase your USB from Barefoot Beach Bride photography for a fee of $250.00. 

Please allow up to 3 weeks for the USB to be mailed to you.

The online gallery will be available for 12 weeks.  If you wish to order prints, the order should be completed in that time frame. 

($25.00 will be charged for each additional week you request the gallery to remain available). 

Custom products such as albums and images are available for an additional fee once you have viewed your online gallery by contacting barefootbrideinfo@gmail.co

·We highly recommend you download your wedding images on a flash drive or cloud software. The galleries will expire causing the loss of your images.

·Barefoot Beach Bride Inc. nor Photographer are responsible for images once your gallery has been received. 

·All additional purchases must be made through Barefoot Beach Bride photography team leader via email at barefootbrideinfo@gmail.com.

·It is also important to consider the time of the client’s ceremony.  Sunrise, sunset, and night lighting ceremonies can affect the appearance of the client’s images. Barefoot Beach Bride does schedule time based around sunrise and sunset, you should keep this in mind and make sure you are on time for your wedding.

PERMISSION TO USE PHOTOGRAPHY/VIDEOGRAPHY.

I, the Client, agree that Barefoot Beach Bride Inc. may use such photographs/videos of me, my family, and friends, with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, social media, and web content. Additional Photographer or Videographer: If the Client is having their own Photographer/Videographer, the Client must notify Barefoot Beach Bride so proper coordination between Barefoot Beach Bride and the Client’s Photographer/Videographer can be consistent. 

·Should the Client request a location or beach placement other than what Barefoot Beach Brides set up, Barefoot Beach Bride or assigned photographer will not be responsible for lights, objects, people, etc. in the Client’s images.    

·Should you request that your images not be used for any of the above, you must submit your request in writing. We will respect your wishes.

·We try and share as many weddings as we can so, please be patient if you have not seen your wedding on our social media, it is never personal. If you have not seen it within 6 weeks reach out, we may have overlooked it, and we will be happy to post. 

Wedding DJ

·Barefoot Beach Bride will assign your reception DJ.

·DJ is contracted for up to 4-hour to execute the cocktail hour and Reception.

·Client is responsible for completing the DJ form on wedding planning form 2 weeks prior to the wedding.

·Clients assigned DJ will call the week of the wedding to review the planning forms to go over questions pertaining to reception music.

External Venue:

·The Client has booked their venue and Barefoot Beach Bride Inc. is a subcontractor to the venue. 

·Clients are responsible for deciding with the hotel in the event of inclement weather. 

·Clients must provide an alternate location to Barefoot Beach Bride the week of the event.  Should the event be moved indoors due to inclement weather?

·Barefoot Beach Bride has the right to change the arbor and decor accordingly to the indoor location. 

·In the event, the Client chooses to proceed with the wedding outdoors,

·Barefoot Beach Bride reserves the right to modify the decor/set-up display. 

·Barefoot Beach Bride will NOT bring any type of floral decor, tiki torches, lanterns, or any additional decor prop that could potentially become damaged due to inclement weather. 

·All electrical equipment including microphones, stereo equipment, photography, videography equipment, etc. cannot get wet. 

. There will be no refunds on services that are affected due to inclement weather. 

·If due to SEVERE weather, clients may reschedule location, date, and time (per availability). 

·Your first payment and/or payments will NOT be refunded. 

·We will transfer all payments to the new date. 

·Rental chairs are to be paid for 72 hours prior to the event with no refund due to inclement weather. 

Music:

Music for your ceremony:

You have two options if you want music during your ceremony.

Option One: BBB Music

1.     1. Barefoot Beach Bride will provide a Bluetooth Speaker.

2. BBB Wedding Music with No selection of songs.

Option Two: I will Provide our own Music. 

1.     1. You the clients will download your song(s) on a Bluetooth-accessible device.

2.     Cell phones are perfect.

2. You will ask a special person you would like to be part of your ceremony, to turn the music on and off during the ceremony. 

We recommend you provide this person with the playlist to download on their cell phone. 

3. Barefoot Beach Bride coordinators will give the Bluetooth speaker and give directions to this person as to when to turn the music on and off throughout the ceremony.

Food & Alcohol:

·There is a no Alcohol on the beach law. 

·Champagne toast is not permitted on the beach. 

· We recommend no food, we have unwanted guests, that love to invite themselves to your wedding. (SEAGULLS)

Parking and Travel:

·When your ceremony is scheduled on 59th Street Ocean Side Beach, you, and your guests are welcome to park in our parking lot located across the street on bayside. 5909 Coastal Hwy. Instruct them to use the crosswalks to walk over to the beach where your ceremony will be taking place.

·59th Street is a Handicap accessible street. Which makes it nice for anyone that could have difficulty walking in the sand or has a wheelchair. (See wheelchairs for questions.

·Ocean City tends to experience heavy traffic and limited parking throughout the summer months (June through August). 

·For the Client’s event to run smoothly and effectively, it is best that all guests, family members, and bridal parties allow enough for travel time and parking. 

·If the ceremony is being held at a venue/ hotel, parking will be available on the premises. 

·Barefoot Beach Bride is not responsible for parking or travel plans to the ceremony location. 

· Transportation Vendors are available on the client access page. 

Beach Wheelchair:

· Beach Wheelchairs are available up to 5:15 PM.  You must see the lifeguard on duty at each location to access the wheelchair.

· Wheelchairs are available at beach locations Memorial Day through Labor Day.

· Beach Wheelchair locations are subject to change pending availability.

· Inlet Lot, 7th St., 27th St., 30th St., 40th St., 48th St., 59th St., 70th St., 81st St., 89th St., 94th St., 107th St., 120th St., 130th St., 139th St., 145th St.

· Additional Beach Wheelchairs at the locations below may be available year-round pending availability.

· Ocean City Police Department at 65th St. bayside, for one or multi-days of use by advance reservation.

· Certain restrictions may apply. Please call 410-723-6610.

· Beach wheelchairs are available from the Ocean City Visitors Center in the Roland E. Powell Convention Center on 40th St. for one to three days of use by advance reservation. 

· Certain restrictions may apply.  Please call 410-289-2800 for further information.

· Beach wheelchairs are not to be taken into the water and are to be used only on the beach. 

Wedding Rehearsal:

· Barefoot Beach Bride does not provide live rehearsals.

. Rehearsal is completed over the phone the week before your wedding. 

· Your wedding coordinator will call you the week of your wedding via phone conference to review the details for your wedding ceremony/dinner or reception.

· Once all the details have been finalized, the Client has access to the itinerary (day-of the timeline) through their planning portal known as Honey book. 

·The planning form/Itinerary consists of the times, locations, and details of the Client’s wedding ceremony and/or reception. 

·Barefoot Beach Bride recommends that the Client thoroughly review the wedding planning form/Itinerary to ensure all the details are correct, you should review with your wedding party, guests, and family, so there is no confusion the day of the event. 

·Under no circumstances is anyone permitted to modify or execute the timeline once it is approved by the    Client and all parties involved. 

·Our wedding coordinators work diligently to ensure that your ceremony and reception run smoothly and is on schedule. Excluding officiant/Officiant photographer services.

Hotel Room Blocks:

·Barefoot Beach Bride is NOT responsible for setting up your Guest Room blocks with the hotel.

·All communication pertaining to Hotel Room Blocks will be with the Sales Director of the Hotel.  

·Barefoot Beach Bride has prepared a recommended list of hotels and rentals along with Contact information for each hotel on our website barefootbeachbridesoc.com under client access page/ hotels.

BBB will not be responsible for any details pertaining to your Guest Room Block

Hold Harmless: 

INDEMNIFICATION AND LIMITATION OF LIABILITY

The Client agrees to indemnify and hold harmless Barefoot Beach Bride Inc and its owners, directors, officers, employees, and agents from all claims, actions, suits, proceedings, damages, liabilities, costs, and expenses, including but not limited to, reasonable attorney’s fees, in connection with or arising from or out of Client’s use of service or premises or occasioned by the negligence, actions or omissions of the Client or its employees, subcontractors, agents or attendees. IN NO EVENT WILL BAREFOOT BEACH BRIDE INC. OR ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR any punitive, special, indirect, incidental, or consequential damages or expenses (including but not limited to the loss of profits, revenues, or business opportunities) INCURRED BY THE CLIENT OR ANY THIRD PARTY FROM ANY CAUSE WHATSOEVER. IN NO EVENT SHALL BAREFOOT BEACH BRIDE INC.’ LIABILITY FOR DAMAGES UNDER THIS AGREEMENT EXCEEDS THE AMOUNT OF THE FEES ACTUALLY COLLECTED FROM THE CLIENT HEREUNDER. The parties executing this Agreement hereby represent that they understand this Agreement and are authorized to bind their respective principals or entities. The Agreement and the Credit Card Authorization may be signed in separate Counterparts, which shall constitute one agreement, binding on all parties. Copies transmitted by fax or electronically will be sufficient and treated as originals.  By signing below, the Client and Barefoot Beach Bride Inc. agree to all of the terms and conditions set forth in this Agreement. The Client and Barefoot Beach Bride Inc. have executed this Agreement individually or by their duly authorized representatives as of the date listed on the Digital Contract/ Booking Form.

Barefoot Beach Bride Inc. wants your special day to go without a hitch and we will work diligently to ensure a flawless occasion. However, certain events beyond our control should prevent us from meeting our high standards, Barefoot Beach Bride Inc. is to be held blameless. We will, nevertheless, do everything in our power to rectify the situation that is outside our normal control. If due to severe weather or any Act of God, Government Shutdowns, Pandemics, Terrorist threats or activities.
